For Ukrainian businesses, trademark registration is becoming more than a formal legal step. A recognizable name, logo or slogan can take years to build, but without registration a competitor may try to secure a similar mark first.

A registered trademark gives the owner exclusive rights to use the sign for selected goods and services. It also creates a legal basis to stop copying, unfair competition and confusingly similar branding.

Why registration matters

The practical benefits go beyond court protection. A trademark can be used to register a domain in the Ukrainian national zone, license a franchise model, increase the intangible value of a company and support customs action against counterfeit imports.

The procedure begins with choosing the correct classes of goods and services. This stage is important because it defines the scope of protection. A mistake can later narrow rights or create grounds for refusal.

Applicants are also advised to conduct a preliminary search for similar marks before filing. The application then goes to the Ukrainian National Office for Intellectual Property and Innovations, followed by formal and substantive examination.

The standard process can be long, with average review taking around eighteen months. During martial law, accelerated procedures are suspended, so businesses should plan ahead. For companies that depend on reputation, packaging, exports or franchising, early trademark registration is often cheaper than fighting for a brand after a conflict begins.
