On April 23, 2021, the President of Ukraine submitted an initiative to consider any assistance of a customs official using his official position as a qualified sign of inaccurate declaration of goods.
Changes will be made to the following articles of the Criminal Code of Ukraine:
- 201 - "Contraband"
- 201-1 "Moving across the customs border of Ukraine outside customs control or with concealment from customs control of timber or sawn timber of valuable and rare tree species, unprocessed timber, as well as other timber prohibited for export outside the customs territory of Ukraine)"
- 305 "Smuggling of narcotic drugs, psychotropic substances, their analogs or precursors or counterfeit drugs"
In accordance with the amendments to article 216 of the Criminal Procedure Code, the authorities supervising the observance of tax legislation will conduct a pre-trial investigation under Articles 201-2, 201-3 and 201-4 of the Criminal Code of Ukraine
Criminal offenses under Articles 201, 201-1, 201-2, 201-3, part four of Article 201-4 of the Criminal Code committed by an official with the use of power or official position will be investigated by detectives of the National Anti-Corruption Bureau of Ukraine.
