American Chamber of Commerce Urges Balanced Regulation of Ukraine’s Pharmaceutical Market

he American Chamber of Commerce (AmCham) in Ukraine has urged the Ministry of Health to adopt a balanced and well-structured approach to changes in pharmaceutical market regulation

This follows the ministry’s proposal for new regulations aimed at aligning with international practices while addressing domestic challenges.

AmCham Comments on Regulation Proposal

Borys Danevych, Co-Chair of the Health Committee of AmCham Ukraine, expressed gratitude for the Ministry of Health’s efforts to refine its approach compared to earlier proposals but highlighted key areas requiring further attention:

  • Acknowledgment of Progress: "The Ministry of Health has demonstrated a more balanced approach in its latest proposals compared to previous drafts," Danevych noted, emphasizing the importance of constructive dialogue between regulators and industry stakeholders.

  • Areas Needing Refinement: Danevych pointed out aspects of the draft regulations that require additional development to ensure the sustainability of the pharmaceutical market and its alignment with global standards.

Learning from the EU Experience

Danevych highlighted the importance of considering European Union regulatory practices when implementing changes in Ukraine. He noted:

  1. Transparency in Pricing: EU regulations emphasize clear and consistent drug pricing mechanisms, ensuring accessibility while promoting innovation.
  2. Regulatory Predictability: Stable and predictable rules foster long-term investments in research, development, and production.
  3. Harmonization with EU Standards: Aligning Ukraine's pharmaceutical regulations with EU directives can enhance market integration and attract global investment.

Call for Collaboration

AmCham stressed the need for continued dialogue between the Ministry of Health, industry representatives, and other stakeholders to ensure that any regulatory changes support:

  • Access to Medicines: Policies should prioritize patient access to affordable and innovative treatments.
  • Industry Growth: Regulations must incentivize investment and innovation while preventing unnecessary administrative burdens.
  • Fair Competition: Clear and transparent rules are crucial to maintaining a level playing field in the pharmaceutical market.

Looking Ahead

The Ministry of Health is expected to incorporate feedback from industry experts and international organizations as it finalizes the proposed regulations. AmCham remains committed to providing expertise and facilitating collaboration to ensure that Ukraine’s pharmaceutical sector thrives in a competitive global market.

This dialogue marks an important step toward building a robust regulatory framework that balances patient needs, market sustainability, and international integration.
