The Verkhovna Rada of Ukraine adopted a law on pre-judgment investigation and in absentia sentencing

The law applies to fugitives from justice in the aggressor country and the temporarily occupied territories of Ukraine

According to DW, on 27 of April 2021, the Parliament of Ukraine on second reading adopted Law 2164 “On introducing amendments to the Criminal procedure code”. The improved law provides a number of legislative options for search and conviction in absentia.

If there is a search warrant for a fugitive, Law 2164 gives the courts the right to consider applications for remand without the presence of the suspect. In the case of such a sentence, the duration of the order and the size of the guard are not specified.

In accordance with Law 2164, the grounds for declaring a suspect on the wanted list and launching a process of early investigation of judicial proceedings are:

  • When the whereabout of the suspect is unknown
  • When a suspect evades a summons from an investigator, a prosecutor, a judge or a court, provided that the suspect is duly informed of the summons
  • When there are reasonable grounds to believe that the suspect is in another country or in temporarily occupied territories of Ukraine
