Types of Employment Contracts in Ukraine’s New Labor Code

The Ministry of Economy of Ukraine is actively working on a new Labor Code that aims to replace the outdated Code of Labor Laws, which was originally adopted in 1971

This new code is being developed in close collaboration with key stakeholders, including business representatives, to ensure it aligns with modern labor market needs and realities.

Proposed Types of Employment Contracts:

  1. Open-Ended Employment Contracts:

    • These contracts are the standard form of employment, where the agreement is not limited by a specific end date. The employee remains employed until either party decides to terminate the contract under the terms specified within.
  2. Fixed-Term Employment Contracts:

    • These contracts have a specific end date or are tied to the completion of a particular project. They are suitable for temporary or project-based work.
  3. Employment Contracts for Remote Work:

    • Designed for employees who work remotely, these contracts outline the conditions and expectations for working from locations outside the employer's premises.
  4. Home Work Contracts:

    • Similar to remote work contracts, but specifically for work carried out at the employee's home. These contracts define the conditions under which home-based work is conducted.
  5. Employment Contracts with Non-Fixed Working Hours:

    • These contracts provide flexibility by allowing employees to work varying hours, as determined by the workload. They are often used in sectors where demand for work fluctuates.
  6. Seasonal Work Contracts:

    • Ideal for industries that experience seasonal peaks, such as agriculture or tourism, these contracts are for jobs that are only available during certain times of the year.
  7. Student Employment Contracts:

    • These contracts are tailored for students, allowing them to gain work experience while continuing their education. They often include flexible working hours to accommodate study schedules.
  8. Employment Contracts with Domestic Workers:

    • These contracts are specifically for domestic workers, outlining the terms of employment, duties, and conditions for those working in private households.

Key Discussions:

  • Labor Dispute Resolution: The new code will include updated mechanisms for resolving disputes between employers and employees, aiming for a fair and efficient process.

  • Labor Inspection: The role of labor inspections will be clarified and possibly expanded to ensure compliance with the new regulations.

  • Electronic Personnel Documentation: The business community highlighted the importance of incorporating electronic personnel document flow, streamlining administrative processes, and reducing paperwork.

The ongoing development of the new Labor Code reflects a commitment to modernizing Ukraine’s labor laws, making them more relevant to today’s work environment, and ensuring better protection and clarity for both employers and employees.
