Ukraine Strengthens Protection of Intellectual Property Rights

On December 23, the Ukrainian parliament passed a bill to strengthen the protection of intellectual property rights

The bill was created to implement the European system of protection of intellectual property rights in the Ukrainian norm. The adoption of this law is a condition for European integration and association with the European Atomic Energy Community. The purpose of the bill is to define procedures and tools for protecting intellectual property rights.

The main points set out in the accompanying documentation to the bill:

  • Amendments to several laws of Ukraine on intellectual property
  • Introduction of particular articles from the Association Agreement with the EU into the legislation of Ukraine: requirements for providing a source of origin of goods and services that infringe intellectual property rights.
  • Introduction of sanction procedures for a preventive fight against IP violations, determination of punitive measures
  • Settlement of IP protection instruments in court
