Why Legal Due Diligence Matters
Buying real estate in Ukraine should begin not only with a physical inspection but also with a thorough legal check of the property and its documents. This protects buyers from invalid ownership rights, encumbrances, and future legal disputes.
1. Verify Ownership Documents
Before signing a purchase agreement, request and review legal proof of ownership. Acceptable documents include (or their duplicates):
-
Contracts: sale, donation, lifelong maintenance, rent, exchange, inheritance, division, or mortgage transfer agreements.
-
Court Decisions: confirming acquisition, change, or termination of ownership rights.
-
Notarial Certificates: on inheritance, privatization, or ownership shares.
-
Auction Certificates: for properties acquired through public auctions.
-
Ownership Certificates: issued before 2013 by local authorities or privatization bodies.
2. Check State Registration of Rights
All rights and encumbrances must be registered in the State Register of Real Rights to Real Property.
-
Current Information: confirms ownership and any encumbrances.
-
Detailed Information: shows history of ownership changes.
-
Access via:
-
State registrars / Administrative Service Centers (paper format)
-
Diya Portal (electronic, limited to current data)
-
3. Look for Encumbrances and Restrictions
Ensure the property is free from:
-
Mortgages or liens
-
Court orders prohibiting registration actions
-
Owner’s voluntary bans on registration actions
-
Arrests or seizures recorded in the State Register
4. Check for Unapproved Alterations
If redevelopment has been done (e.g., removal of supporting walls), verify:
-
Official permits exist
-
A new technical passport has been issued
5. Check for Debts and Utility Arrears
Request confirmation that there are no unpaid utility bills.
6. Verify Court Disputes & Sanctions
-
Use the Unified State Register of Court Decisions to ensure no ongoing disputes over the property.
-
Check that the seller is not in the Unified Register of Debtors.
-
Verify in the State Register of Sanctions that no sanctions are applied to the seller.
✅ Tip for Investors: Always conduct both legal and financial checks before transferring any money. Hiring a qualified notary and lawyer in Ukraine is essential to ensure the transaction is fully compliant and risk-free.
