Ukraine’s Verkhovna Rada Streamlines Customs Process for Biomethane

The Verkhovna Rada, Ukraine’s parliament, has passed amendments to the Customs Code of Ukraine and other relevant laws aimed at regulating the customs control and clearance of biomethane, among other categories of goods

This legislative update, encapsulated in bill No. 9456, is designed to promote the development of a new energy production sector and support Ukraine's international commitments to decarbonization.

The adjustments specifically address the customs control and clearance procedures for biomethane transported via pipelines across Ukraine's customs border. The new process necessitates customs clearance based on the volumetric information of biomethane, which, due to its physical and chemical properties, may be replaced by an equivalent volume of natural gas or their mixture, at each gas receipt and transfer point individually.

For customs clearance, the declarant is required to provide:

  • A periodic customs declaration, detailing the biomethane producer's account number in the biomethane registry, as stipulated in Article 81 of the Law of Ukraine "On Alternative Fuels".
  • An additional customs declaration, featuring information on the biomethane's guarantee of origin in accordance with Article 82 of the same law, for the respective biomethane quantity.

Furthermore, the clearance of biomethane amounts transported across Ukraine's customs border by pipeline under FZ agreements (contracts) will be conducted in alignment with the prerequisites of Article 83 of the Law of Ukraine "On Alternative Fuels". This legislative move marks a significant step towards enhancing Ukraine's energy sector's sustainability and aligning it with global environmental standards.
