International Criminal Court Opens in Ukraine

The ICC will hear cases and prosecute all those guilty of 2014 war crimes

The Ministry of foreign affairs of Ukraine reported that the government had voted in favour of the draft agreement with the International Court. This means that Kyiv recognizes the right of the International Criminal Court to identify, prosecute and try in Ukraine. One of the activities of the international criminal Court in Ukraine will be to search for and punish all perpetrators and accomplices of crimes committed by Russia in the territory of Ukraine. It is noted that the Court will consider cases not only from February 24, 2022 but also the Revolution of Dignity, crimes committed since the beginning of the Russian invasion of Ukraine on February 20, 2014. The Rome Charter of international law will guide the Court. Thus, the primary competence of the branch of the International Criminal Court in Ukraine will be prosecuting persons responsible for war crimes and genocide of the Ukrainian people for nine years.

We note that in early 2023 Ukraine submitted to the European Parliament a proposal for establishing an international tribunal for the Russian Federation. The initiative to establish a special tribunal has already been supported by some of Ukraine’s allies. But opening a branch of the International Criminal Court in Ukraine will help to quickly realize the right of the country to punish the perpetrators of many tragedies and deaths of the Ukrainian people.
